As a result of the Initiative after the Civil War, Tony Stark forms a new team of Avengers. This government sponsored Initiative team became the primary team when the New Avengers became outlaws due to the registration act that was initiated. Although The Avengers Vol.1 title used the banner "The Mighty" Avengers for some time in the mid 1980's, it was always named "Avengers" in the indica, making this the true first title to have the name.
